Terms & Conditions

These terms govern the relationship between Pendulia ("the Workshop") and any person who engages the Workshop for watch inspection, service, or restoration work, or who uses the website at penduliaad.biz. By submitting a watch for service or making an enquiry via the website, the customer accepts these terms.

1. Service Engagement and Estimates

All service engagements begin with a bench inspection (S-01: Bench Diagnosis and Estimate). A written condition report and tiered estimate are provided on completion of the inspection. The customer may then choose to proceed with recommended work, proceed with a subset of the recommended work, or collect the watch without further service.

The inspection fee (RM 750) is charged regardless of whether the customer elects further work. If the customer proceeds to a full movement service (S-02) or dial restoration (S-03), the inspection fee is credited in full against the cost of that subsequent work. The credit applies to one further service engagement only and is not transferable.

Estimates produced at inspection are valid for 60 days. Parts availability and pricing may change after that period, and a revised estimate may be required before work proceeds.

Work does not commence until the customer has confirmed acceptance of the estimate in writing (by email, post, or in person). Verbal acceptances are not actioned until confirmed in writing.

2. Pricing and Payment

All prices are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated. Current service prices are:

Where parts replacement is required during a service, the Workshop will advise the customer before parts are ordered. Parts costs are not included in the base service prices listed above and will be itemised separately on the final invoice.

Payment is due in full upon collection of the watch. The Workshop accepts cash and bank transfer. Watches will not be released until payment has cleared in full. The Workshop does not hold watches as security for outstanding balances beyond 90 days from the date the customer was notified of completion; uncollected watches are subject to the provisions of Section 7 below.

3. Customer Responsibilities at Intake

The customer is responsible for providing accurate information about the watch at intake, including any known history of prior service, modifications, or damage. Inaccurate or incomplete information may affect the accuracy of the inspection report and estimate, and the Workshop accepts no liability for diagnostic conclusions based on information the customer withheld.

The customer warrants that they are the owner of the watch or are authorised by the owner to commission service work. The Workshop accepts no liability for watches submitted by persons not authorised by the owner.

At intake, the Workshop will record the watch's condition by photograph. This record is maintained as part of the service file and is available to the customer on request.

4. Turnaround Times and Delays

The Workshop provides indicative turnaround estimates at the time of estimate acceptance. These are estimates only. Actual completion may vary due to parts availability, workload, or unforeseen complications discovered during the course of work.

Where a complication or parts delay extends the expected turnaround by more than 14 days, the Workshop will notify the customer in writing and provide a revised completion estimate. The customer may, upon written notice, withdraw from the engagement at that point without charge for any work not yet commenced. Work already completed at the time of withdrawal is chargeable at the rate specified in the original estimate.

The Workshop does not commit to specific completion dates. Turnaround estimates should not be relied upon for travel, insurance, or other time-sensitive arrangements.

5. Dial Restoration — Third-Party Specialist

Dial restoration work (S-03) is carried out off-site by a specialist with whom the Workshop has a long-standing working relationship. By electing dial restoration, the customer consents to the watch dial being transferred to that specialist for the duration of the restoration work.

The Workshop acts as the sole point of contact for the customer throughout this process. The customer's contractual relationship is with the Workshop, not with the off-site specialist. The Workshop remains responsible for the overall service engagement.

Restoration work, once elected and commenced, may not be reversed. The Workshop will provide a written pre-restoration report at the S-01 stage, describing the dial's present condition and the proposed scope of work. The customer should review this report carefully before authorising restoration to proceed.

6. Limitation of Liability

The Workshop takes reasonable care in the handling, inspection, and servicing of all watches. However, the Workshop's liability for any loss or damage to a watch in its custody is limited to the lower of the watch's insured value (if declared by the customer at intake) or the Workshop's assessed replacement cost for a comparable calibre and case. Sentimental value and collector premiums are not factors in the Workshop's liability assessment.

The Workshop is not liable for: pre-existing conditions not evident on initial inspection; damage arising from components that could not be assessed without full disassembly; or age-related deterioration of components that appeared serviceable at the time of service but degraded within a normal service cycle.

The Workshop is not liable for indirect or consequential losses of any kind, including loss of use, business interruption, or reduction in watch value.

Nothing in these terms limits the Workshop's liability for losses caused by its own negligence or wilful misconduct.

7. Uncollected Watches

Upon completion of service, the Workshop will notify the customer that the watch is ready for collection. The customer is expected to collect the watch and settle payment within 30 days of this notification.

Watches not collected within 90 days of completion notification will be held in secure storage at a storage charge of RM 20 per week, accruing from day 91. The Workshop will make reasonable efforts to contact the customer by the contact details provided at intake before storage charges begin.

Watches not collected and unpaid for after 12 months from completion notification may, following written notice to the customer's last known contact address, be offered for sale to recover outstanding service fees and storage costs. Any surplus from such a sale, after costs are recovered, will be held for the customer for a further 12 months before being donated to a charitable organisation.

8. Website Use

The website at penduliaad.biz is provided for information purposes. Content is maintained with reasonable care but the Workshop does not warrant that information on the website is complete, current, or free of error. Service descriptions, prices, and workshop hours on the website should be verified directly with the Workshop before a customer relies on them for planning purposes.

Contact forms on the website are for enquiry purposes only and do not constitute a service booking or contractual commitment by either party. An engagement commences only when the Workshop confirms acceptance of a watch for inspection in writing.

Users may not use the website in a manner that interferes with its operation or that is unlawful. The Workshop reserves the right to restrict access for users who misuse the contact facilities.

9. Governing Law

These terms are governed by the laws of Malaysia. Any disputes arising from service engagements or use of the website are subject to the non-exclusive jurisdiction of the courts of Malaysia.

The Workshop encourages customers to raise any concerns directly in the first instance. The Workshop will endeavour to resolve disputes informally before any formal proceedings are considered.

10. Amendments to These Terms

The Workshop may amend these terms at any time. The current version will be posted on this page with the date of last update. Amendments do not apply retrospectively to service engagements already underway at the date of amendment.
